We just won that one  that case at a cost of over $16,000.00 in legal fees, and of course we never got any compensation for the hundreds and if not thousands of hours we spend defending this law suit. One of the worst & abusive HOA's I have dealt with.. to ANYONE considering
the purchase of a home in this community do Yourself a favor...read the governing
documents of this HOA that will rule Your roost as well look up the many,
many, many filings by Donald Peyton on behalf of the HOA's He represents...This
Atty. does very well lining His pockets, at every Homeowners expense, pursuing a
fair amt. of bogus , non-factual and non-existent deed violations ..The most
recent of which I'm sure BWEHA is currently reeling from...as THEY (BWEHA) just
lost the case they pursued like rabid dogs for years and just cut a check in excess
of $16,000 to the Homeowner they made false allegations against of Deed restriction
violations..PLUS they paid Mr. Peyton about $10,000 in Fees to pursue the Homeowner for a NON-EXISTENT violation ... Aprx. $26,000 of WASTED FUNDS @ EVERY HOMEOWNERS EXPENSE, they did not disclose that to homeowners at any meetings!
This attitude as quoted from the minutes of the August Meeting is the problem with many  HOA's "Mrs. Fredricksen stated that our attorney has strongly advised us to remain a complaint driven community, in part, so we cannot be accused of favoritism. Mr. Stith also commented that associations have to be very sure of their ground before taking a homeowner to court because if a decision goes against them, the legal fees could mean financial ruin." oh, yea..I want to live in a "complaint driven community"..not.

 

In another lawsuit, same attorney different homeowners association this hoa had and never did have any legal rights to collect fees or enforce any rules. They slapped a lien on the property once they found out I was purchasing the property in 2001. We were forced to pay approximately $1300.00 to get clear title in which took months to get plus it cost me they sale of the home we were selling and lost money there.

We filed suit against this attorney and the hoa over 3 years ago. 3 counts, fraud, no power, and other civil and other crimes that are criminal in nature. They filed a lien on our property for unpaid fees and started foreclosure over an alleged $57. In our suit we just one 1 count summary judgment that they had no right to collect any fees or dues and had no right to enforce anything. We not only one they and their attorney's stipulated on the record that they had not rights, but our property still has a cloud on the title. We have the house under contract to sell and again this attorney is releasing the lien and dismissing their foreclosure action. Looks like this sale is going to be lost. We have spent thousands of dollars. Fighting and defending your rights is costly and time consuming. One of the biggest problems is that most people do not, and then they wonder why the county and the system is so screwed up. It is a sham, but we have to fight for our rights. The other problem out there is that there are so many bad attorneys’ it is tough to find the right one for the job.

What type of a person can make that kind of a statement. You guessed it, only an attorney, one which I think should not allowed to operate as an attorney.

Not only does it appear that he does not have any respect for hardworking homeowners it appears he has no respect for the Florida Attorney General's Office

Donald Peyton on behalf of homeowners associations throughout Pasco County and other County's has been filing what I believe are frivolous lawsuits against honest hard working families and property owners for years. His attitude has been, even when there is serious allegations made concerning a homeowners association right to enforce anything he states, and I quote him " unless a judge decides contrary to my position, I recommend you continue to operate accordingly." In my opinion this is an arrogant and egotistical person. This is a person that does not serve the community well. When Donald Peyton gets involved it seems that all he is doing is creating work so that he can make money for himself by pitting homeowner against homeowner.
